Terms of Service

These Terms of Service ("Terms") govern your use of Fieldera, a field service management platform available at fieldera.app (the "Service"), operated by Trago LLC, an Ohio limited liability company ("Trago LLC", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the company you represent ("you" or "Customer"). If you do not agree, do not use the Service.
1. The Service
Fieldera provides web-based tools for field service businesses, including job scheduling, crew dispatch, time tracking, GPS crew tracking, quoting, invoicing, and customer management. Features vary by subscription plan as described on our pricing page.
2. Accounts
You must provide accurate information when registering and keep your credentials secure. You are responsible for all activity that occurs under your account, including activity by crew members and other users you invite. You must be at least 18 years old and authorized to bind your company to these Terms.
3. Free Trial
Every plan includes a 14-day free trial with full access to the plan's features. No credit card is required to start a trial. If you do not subscribe to a paid plan by the end of the trial, your access may be suspended until you do. We may modify or discontinue trial offers at any time, but changes will not affect trials already in progress.
4. Subscriptions, Billing, and Cancellation
- Billing. Paid subscriptions are billed in advance on a monthly or annual basis through Stripe, our payment processor. By subscribing, you authorize recurring charges to your payment method.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current rate unless cancelled before renewal.
- Cancellation. You may cancel at any time from your account settings or by contacting support@fieldera.app. Cancellation takes effect at the end of your current billing period, and you retain access until then. Except where required by law, fees already paid are non-refundable.
- Price changes. We may change subscription prices with at least 30 days' notice; changes apply at your next renewal.
- Non-payment. If a charge fails, we may retry it and, after reasonable notice, suspend the account until payment is brought current.
5. Your Data
You own the data you and your users enter into the Service, including customer records, jobs, quotes, invoices, time entries, and photos ("Customer Data"). You grant us a limited license to host, process, and display Customer Data solely to provide and support the Service. You can export your Customer Data while your account is active, and we will provide a reasonable opportunity to export it after cancellation. Our handling of personal information is described in our Privacy Policy.
You are responsible for the accuracy and lawfulness of Customer Data, including obtaining any consents required to store your customers' information and to track crew locations where you enable GPS features.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to gain unauthorized access to the Service, other tenants' data, or our infrastructure
- Probe, scan, or test the vulnerability of the Service without our written permission
- Interfere with or disrupt the Service, including by transmitting malware or placing unreasonable load on it
- Resell, sublicense, or white-label the Service except as expressly permitted by your plan
- Use the Service to send spam or unsolicited communications
- Copy, reverse engineer, or create derivative works of the Service except as permitted by law
We may suspend or terminate accounts that violate these Terms, with notice where practicable.
7. Availability and Support
We work to keep the Service available and performant, but the Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at any particular time, and we may perform maintenance that temporarily limits availability. We recommend you maintain your own copies of critical business records. Support is available by email at support@fieldera.app.
8. Intellectual Property
Trago LLC owns the Service, including its software, design, and branding. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service during your subscription. Feedback you provide may be used by us without obligation.
9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAGO LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, OR LOST DATA, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
11. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your access for material breach of these Terms, for non-payment, or if required by law. Upon termination, your right to use the Service ends; Sections 5, 8, 9, 10, and 12 survive termination.
12. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law rules. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Ohio, and you consent to their jurisdiction.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify account owners by email or by a notice within the Service at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
